Sec.13.04 RIGHTS OF Si1B,TECTS OF DATA Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this secdon. ` Subd.2. Information required to be given indiridual, An individual asked to supply private or confidential data concerning himself shall be informed of: (a)the purpose ar.d ir.ter.ded use of the requested data wi[hin the collecdng state agency,polidcal subdivision,or statewide ryscem;(b)whether he may refuse or is legally required to supply the requested data;(c)any lmown coruequence arising from his supplying or r�fusing ta supply private or confidenaal dara;and(d)the identiry of other perso�s or enaaes authorized by stite or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investi;ative data, pursuant to section 13.82, subdivision 5, to a law enforcemznt officer. The commissioner of revenue mav lace the notice reouired vnder this subdivision in the individual income taz or ro errv tax refund instrucdons instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible auchoriry,an individual shall be informed whether he is the subject of stored data on individuals,and whether it is classified as public,private or conFdenaal. Upoa his further request,an individual who is tt;e subjzct of stored private or public dac�on individuals shall be shown the data without any charge to him and, if he desires,shall be informed of the con�znt and meaning of that data. Aher an individual has been shown the private data and informed of its meaning,che data need not be disclosed�o hirn for six montiu thereafter uriless a dispute or acdon pursuanc to this secdon is per.ding or addirional data on the individual has been collectzd or created. The resporuible au[horiry shall provide copies of the private or public data upon request by the individual subject of the data. The responsible auchoriry may require the requesring person to pay the actual costs of making,certifying,and compiling the copies. The responsible authoriry shall comply immediac�ly,if possible,with any request made pursuant to this subdivision, or within five days of the date of the request,excludin,Saturdays, Sundays and legai holidays,if immediate compliance is not possible. If he cannot compiy wttta the request within that time, he shall so inform the individual, and may have an addiaonal five days within which to comply with the requesc, excluding Szturdays,Sundays and legai hoIidays. Sa�d.4. Procedure when data is not accurate or complete. An individua(may contest�ze accuracy or completeness of public or private dara concerning himself. To exercise this right,an individual shali noti;y in writing the responsible authoriry describing the t�ature of the disa,reement. The responsible authoriry shall within 30 days either: (a)coaect tl:e daa found to be inaccurate or incomplece and attempt to noafy pasc recipiena of inaccurate or incomplete dara,ir.cluding recipienu named by the individual;or(b)nocify the ir,dividual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disaoreement is included with the disciosed data.
