A building permit was issued to permit construction of a ne�v residence on the <br /> property based on a site plan that �vas submitted with the original building permit <br /> application. A Temporary Certificate of Occupancy (T.C.O.) has been issued with <br /> the requirements all the site grading and drainage plans are completed within 180 <br /> davs. <br /> 2. At the time the building permit was approved, the submitted site plan met all <br /> requirements of the zoning ordinances and building code. After additional review <br /> of the site plan it was discovered the 75' lakeshore setback was not measured <br /> conectly. The site plan indicated a 75' setback to the lakeshore (east side of the <br /> property). However, it was discovered the lakeshore bends around an adjacent <br /> property within 7�' of this property. This resulted in more area of the property being <br /> included in the 0-7�' protected zone where no hardco��er is allowed. As a result, the <br /> area of the 7�-250' zone is actually smaller than initiallv indicated, and the owners <br /> have had to omit certain items of hardcover to remain at the 25% level. <br /> ;. When the setback issue was discovered, construction of the new home was nearly� <br /> complete. Since the house�vas nearly complete, it���as not possible for the property <br /> owners to reduce the size of the structure. To conform to the hardcover <br /> requirements,the property owners had to reduce the size of the driveway,and remove <br /> a concrete patio from the plans. Neither had been constructed. <br /> 4. Swales are being provided around the house to direct«-ater from the road, drive�vay <br /> and roof around the house and beyond the adjacent homes where the�vater will then <br /> naturally flow towards the lakeshore. <br /> 5. In addition to the drainage s�vales, gutters are bein� added to the northeast roof line <br /> to direct�vater to���ards the front of the house and not to��-ards the neiahborin�house. <br /> Draintile �vill also be installed to take the �vater from the house around to the front <br /> of the banl:. Final grading and the draintile �vill not be completed until the grounci <br /> tha�vs in the Spring. Because the additional gradina and drainage improvements <br /> cannot be completed until Spring,staff issued a T.C.O.rather than a final Certificate <br /> of Occupancy(C.O.). When the improvements are complete, a C.O. �vill be issued. <br /> The City of Orono has routinely allowed individuals to occupy a home by a T.C.O. <br /> �vithout all the exterior �vork being complete subject to a defined time period to <br /> complete the work. <br /> Pa�e 2 of 6 <br />
