CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. d5?9 <br />WHEREAS, on May 18, 2015, the Planning Commission's recommendations were based on <br />the following findings. <br />PLANNING COMMISSION FINDINGS <br />Regarding the additions and modifications to the existing home: <br />1) The proposed one—story additions or modifications to the home will be low profile, will not <br />be visible from the lake, and will not adversely impact existing lake views enjoyed by <br />adjacent lakeshore properties. <br />2) The variance to allow additions and modifications to the home within the 100 foot lake <br />setback will alleviate a practical difficulty inherent to the location of the existing home on <br />the Property and not created by the Applicants. <br />3) The Applicants' proposal to construct additions and make modifications to the existing <br />home results in 28,909 square feet of hardcover or 11.1% where 25% is the maximum <br />permitted by code; the Property exceeds 2.0 acres therefore structural coverage <br />limitations do not apply. <br />4) The proposed additions to the home are not out of character with the neighborhood and <br />will meet side and rear setbacks. <br />Regarding the in -ground pool: <br />5) The variance to place hardcover and structure within the 75 -foot setback limits <br />opportunity for stormwater infiltration and is not in harmony with the general intent and <br />purpose of the Ordinance. <br />6) The variance to construct an in -ground pool consisting of structure and hardcover within <br />75 feet of the OHWL is inconsistent with the comprehensive plan. <br />7) The applicant has not established that there are practical difficulties. <br />8) The variance to allow an in -ground pool to be constructed within 75 -feet of the OHWL is <br />inconsistent with the majority of the large lot properties in Orono on Long Lake and will <br />alter the essential character of the locality. <br />9) The Applicants have sufficient alternate locations to on the Property to construct a <br />conforming in -ground pool; the granting of the variance to permit an in -ground pool to be <br />constructed within the 75 -foot setback is not necessary for the preservation and <br />enjoyment of a substantial property right of the Applicants. <br />Page 2 of 6 <br />
