CITY F O r4�.-IIIN <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 658® <br />WHEREAS, the property owner has formally requested that the property be <br />incorporated into the MUSA to allow for future connection to the municipal sewer system; and <br />WHEREAS, in light of the above noted facts the Orono Planning Commission <br />pursuant to published and written notice held a public hearing on November 16, 2015 and on a <br />vote of 6-0 recommended that the property at 480 Russell Avenue be added to the MUSA; and <br />WHEREAS, Metropolitan Council staff have confirmed that this property can be <br />added to the MUSA through an administratively -approved amendment to the CMP. The <br />amendment is exempt from the 60 -day comment period by adjacent jurisdictions because it is <br />less than 40 acres in area, it does not change any Metropolitan Growth Forecasts, and is further <br />from adjacent jurisdictions than the City's standard notification distance; and <br />WHEREAS, based on staff calculations, inclusion of the property in the MUSA <br />will not drop Orono's density calculation below the 3.0 units per acre threshold; and <br />WHEREAS, the Orono City Council on December 14, 2015 voted 5-0 to <br />conditionally approve an amendment of the 2008-2030 Community Management Plan (CMP) to <br />include 480 Russell Avenue in the Metropolitan Urban Service Area subject to Metropolitan <br />Council review and approval, and directed City staff to prepare such an amendment and submit it <br />to the Metropolitan Council for review and approval; and <br />WHEREAS, on December 17, 2015 documentation for the proposed amendment <br />was submitted to the Metropolitan Council for review and approval; and <br />WHEREAS, on January 8, 2016 the Metropolitan Council indicated to the City <br />via letter that the 2008-2030 CMP Amendment to include 480 Russell Avenue within the MUSA <br />meets the Comprehensive Plan Amendment Administrative Review Guidelines adopted by Met <br />Council on July 28, 2010. The proposed amendment does not affect official forecasts, or the <br />City's ability to accommodate its share of the region's affordable housing need. Therefore, Met <br />Council will waive further review and action, and the City may place this amendment into effect. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Orono hereby amends the 2008-2030 City of Orono Community Management Plan Part 4C, <br />Comprehensive Sewer Policy Plan (CSPP) by incorporating into the MUSA the property at 480 <br />Russell Avenue described in attached Exhibit A, finding that: <br />Page 2 of 3 <br />
