RESOLUTION OF THE CITY COUNCIL <br />NO. 6579 <br />A RESOLUTION <br />EXTINGUISHING CONDITIONAL USE PERMIT APPROVED <br />AS RESOLUTION 3561 <br />WHEREAS, John B. Goodman Limited Partnership, a Minnesota limited <br />partnership (hereinafter the "Owner"), is the owner of the property legally described as: <br />Tract B, Registered Land Survey No. 1630, Files of the Registrar of Titles, in and for <br />Hennepin County, Minnesota (hereinafter the "Property"); <br />WHEREAS, Freshwater Foundation was previous owner of Property, and <br />received a Conditional Use Permit to use the facility as a research and educational center on <br />May 22, 1995; and <br />WHEREAS, this Conditional Use Permit was approved via Orono Resolution 3561 <br />and was recorded at Hennepin County on June 10, 2996 as document 2711570; and <br />WHEREAS, Owner requested the Conditional Use Permit be extinguished <br />formally by Council action on December 4, 2015, as the Owner does not operate a research and <br />educational center. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested extinguishment of the Conditional Use Permit as described above <br />based on one or more of the following findings of fact concerning the Property: <br />FINDINGS OF FACT: <br />1. The original Conditional Use Permit application was reviewed as Zoning File #2013. <br />2. The Property is located in the B-4, Office and Professional Business Zoning District. <br />3. The Property is proposed to be used as an Office building, which is a permitted use in the <br />B-4 zoning district. <br />ANALYSIS: <br />1. "The Owner does not conduct research or education activities requiring a conditional use <br />permit. <br />CONCLUSIONS ORDER AND CONDITIONS: <br />Based upon one or more of the above findings, the Orono City Council hereby vacates or <br />otherwise repeals the Conditional Use Permit approved via resolution 3561 in May, 1995. <br />184312v1 <br />
