CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> N O. <br /> 0576 <br /> lAkE S H O�� <br /> construct the additions to the home will not impact health, safety, comfort, or morals or be <br /> contrary to the zoning code. <br /> 12. "The granting of such variance will not merely serve as a convenience to the applicant, but <br /> is necessary to alleviate demonstrable difficulty." Granting the average lakeshore setback <br /> variance to construct the additions will alleviate a difficulty created in the orientation of the <br /> Property and surrounding properties. <br /> CONCLUSIONS. ORDER AND CONDITIONS: <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction of a second <br /> story over a portion of the home; roof modifications over a portion of the home to accommodate <br /> the second story addition; and construction of an open covered porch between 38-feet and 91- <br /> feet lakeward of the average lakeshore setback line where no structures are permitted; subject to <br /> the following conditions: <br /> 1. Council approval is based on the survey dated 11/17/15 and building plans submitted by <br /> the Applicants and annotated by City staff, attached to this Resolution as Exhibits A& B. <br /> Any amendments to the plans which are not in conformity with City codes may require <br /> further Planning Commission and City Council review. <br /> 2. Authorities granted by this resolution run with the Property not with the Owner, but are <br /> permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing construction of said project. A framing inspection must be <br /> completed within one year of the date of Council approval, or the variance will expire on <br /> that date(January 11, 2017). <br /> 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall <br /> constitute a violation of the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> 4. The undersigned Applicant has read, understand and hereby agree to the terms of this <br /> resolution and on behalf of the Owner and the Owner's heirs, successors and assigns, <br /> hereby agree to the recording of this resolution in the chain of title of the Property. <br /> ADOPTED by the Orono City Council on this 11th day of January, 2016. <br /> 4 <br />
