Pudil and Gail R, Pudil (hereinafter the "Owners") are <br /> owners of the properties within the City of Orono (hereinafter the "City") located at 2414 and <br /> , <br /> ' 2416 Carnlan Stree'�and legally described as follo�vs: <br /> `,. _,........__-.J <br /> _,. _ <br /> 2416 Carman Street <br /> Lot 1 Block 1 Lelunan Lagoon, Hennepin County, Minnesota <br /> and <br /> �n i n.,.M_.._.. ... � <br /> u-tt� �,aiiiiau uZZ� <br /> Lot 2 Block 1 Lehman La�oon, Hennepin County, Minnesota <br /> (hereinafter the "Properties"); and <br /> WHEREAS, Lot 1 is vacant except for a shed and Lot 2 has a house; and <br /> WHEREAS, Lot 1 has a five foot utility easeinent along its east lot line and Lot 2 <br /> has a five foot utility easement alon� its west lot line and the Owners wish to construct an <br /> addition to the house on Lot 2 that would encroach into these easements; and <br /> �H�REAS, on July 5, 2006 the Owners filed an application for the proposed <br /> easement vacation; and <br /> W�-IEREAS, after due published and iilailed notice in accordance ��ith Miiulesota <br /> Statutes 462.358 et. seq. and the City of Orono Zoning Code, the Orono Plaruling Commission <br /> held a public hearing on the application on August 21, 2006, at which time all persons desiring to <br /> be heard concerning this a��licatiuii were gi-ven thc opporttttlity to speal: thereon; and <br /> ��'g-iEREAS, on August 21, 2006 the Planning Commission recommended <br /> approval of the application, conditioiled on receipt of letters fi�om the utility companies <br /> consentina to the vacation and on the two lots being legally combined; and <br /> Pagelof� <br />
