Date Application Received: 10/21/15 <br />Date Application Considered as Complete: 10/30/15 <br />120‐Day Review Period Expires: 02/27/16 <br /> <br />REQUEST FOR COUNCIL ACTION <br /> Date: February 8, 2016 <br />Item No. 7 <br />Department Approval: Administrator Approval: Agenda Section: <br />Name: Melanie Curtis mcc JML Planning <br />Title: Planner <br />Item Description: <br />#15‐3795, Southview Design o/b/o Robert & Beth Schnell, 1130 Old Crystal Bay Rd S , Variances ‐ Resolution <br /> <br />Application Summary: <br />On January 25th the Council considered the applicant’s request for variances in order to construct a pool, pool <br />patio, deck and pergola on the property lakeward of the average lakeshore setback and 150‐foot lake setback; <br />and a structure to structure setback variance between the proposed pool and deck expansion. A hardcover <br />variance to permit installation of stepping stones between lake access stairs within the 75‐foot setback area <br />was also requested. The Council voted 3 to 1 to approve the requested setback variances, and to deny the <br />hardcover within the 75‐foot zone. The dissenting voter was amenable to approving the stepping stone <br />pavers as shown on the plan. <br /> <br />Planning Commission Recommendation <br />On January 19, 2016, the Planning Commission continued the November public hearing and reviewed the <br />revised plans. The Commission voted 5 in favor and 1 against on a motion to approve the revised plan as <br />submitted. The dissenting commissioner was opposed to the allowance of stepping stones within the 75‐foot <br />zone to connect the stairs. <br /> <br />Planning Staff Recommendation <br />Staff has provided draft resolution reflecting the following for Council’s consideration: <br />1. Approval of an average lakeshore setback variance; <br />2. Approval of a lake setback variance to allow structure within the 150‐foot setback of French Lake; <br />3. Approval of a structure‐to‐structure setback variance to allow the pool to encroach as close as 6 feet <br />to the pergola and dining deck; and <br />4. Denial of a hardcover variance to permit stepping stones within the 75‐foot zone. <br /> <br />COUNCIL ACTION REQUESTED <br />Council should consider adopting or amending the approval resolution. <br /> <br />List of Exhibits: <br />Exhibit A.
