KOZLAK and JODEEN A. KOZLAK <br /> (hereinafter "Owners") are the owners of the property located at 1635 Bohns Point Road <br /> within the City of Orono (hereinafter "City") and legally described as: Tract B, Registered <br /> Land Survey No. �65, files of the Registrar of Titles, Hennepin County, Minnesota <br /> (hereinafter "the Property"); and <br /> WHEREAS, on August 24, 2009 the City Council of the City of Orono <br /> adopted Resolution No. 5860 granting the Property average lakeshore setback, lakeshore <br /> setback, structural coverage, and hardcover variances so that additions to the existing <br /> residence could be constructed. The approval remained valid if a building permit for the <br /> residence was issued by August 24, 2010; and <br /> WHEREAS, since a building permit has not been issued the Owners have <br /> made application to the City to renew the approval, with no change in the plans; and <br /> WHEREAS, Resolution No. 5860 was inadvertently recorded without the <br /> hardcover summary as part of Exhibit A. <br /> WHEI�EAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on July 19, 2010, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. Immediately <br /> following the public hearing the Planning Commission recommended approval of the <br /> application by a vote of 5 - 0. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota that Resolution No. 5860 is amended to change the deadline for obtaining a <br /> building permit to August 24, 2011 and to add the hardcover summary attached as Exhibit A <br /> as the second and third pages of Exhibit A to Resolution 5860. Resolution No. 5860 <br /> otherwise remains in effect. <br /> Page 1 of 2 <br />
