The Planning Commission reviewed this application on May 18, 2009 and on a
vote of 7 - 0 recommended approval of setback variances to allow a 25 foot
deep by 30 foot wide garage placed so the south wall of the garage is in a line
with the north wall of the house (approximately 5.8 feet from the north
property line} and so the southeast corner of the garage is 10 feet from the
northwest corner of the house (approximately eight feet from the right of way
of Arbor Street). This recommendation is based on the following findings:
a. It is a hardship to not have a garage.
b. A garage of the size proposed is necessary to accommodate vehicles as
well as the equipment necessary to maintain the property.
c. The proposed desin and approved location is compatible with the
surrounding area. There are detached garages across the street that are
located very close to the right of way. The adjacent house to the north is
located only 24 feet from the right of way.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. Notwithstanding the recommendation of the Planning Commission the City
Council finds that a 26 foot deep garage is necessary to accommodate vehicles
and maintenance equipment and that the topography of the lot makes it
unreasonable to place the garage any farther than two feet from Arbor Street.
6. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
-anting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Owners but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the Owners; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
