City records include very little information about the dump lacated on�lie propei�ty. Aerial photo evidence dating back to the mid-1950s suggests that all but the easterly 2+acres of the site has beer�filled at some time in the past. We know that there have been efforts by the property owner through the years to add clean fiIl over the dutnp areas to bury the debris accumulation, per general recommendations of the MPCA. The dump has long been a concern of the City because one of the major subwatershed creeks feeding Lake Minnetonka flows tIu•ough the filled area. We have no records of what was durriped at the site, the actual boundaries of the dumpuig, what types of znaterials were dumped, or whether any potentially hazardous materiais were involved. When faced with questions about the property from potential purchasers, the City is obligated to disclose available information. The fact that we know very little about the dump apparently raises red flags for most prudent p�u•chasers. We have no Certificate of Survey of the property on file. We have been asked about whether the property is subdividable. We believe it is not subdividable base�on the current zoning regulations that require 2.0 acres of dry buildable land and 200' of width per building site. The vzability of the property just as a single building site for new construction i_s also a question mark given the required boundary setbacics,wetland setback and buffer requirements, well setback from Iandfill areas, the need for two on-site sewage treatment system sites meetin�required separations from the creek, wetland and well, etc. These questions will likely not be answered fully until the property owner or purchaser provides a Telephone(952}249-4600 • Fax(952}249-4616 www.ci.orono.mn.us
