Aerial photo <br /> evidence datinb back to the mid-19�Os suggests that all but the easterly 2+ acres of the site has <br /> been filled at some time in the past. We know that there ha��e been efforts by the property owner <br /> through the years to add clean fill over the dump areas to bury the debris accumulation, per <br /> general recommendations of the MPCA. The dump has lonb been a concern of t11e City because <br /> one of the major subwatershed creeks feeding Lake Minnetonka flows through the filled area. <br /> We have no records of what w�as dumped at the site, the actual boundaries of the dumping, what <br /> types of materials �vere dumped, or whether an}� potentially hazardous materials were involved. <br /> When faced w�ith questions about the property from potential purchasers, the City is obligated to <br /> disclose available information. The fact that we know very little about the dump apparently <br /> raises red flags for most prudent purchasers. We have no Certificate of Survey of the property <br /> on file. We have been asked about whether the property is subdividable. We believe it is not <br /> subdividable based on the current zoning regulations that require 2.0 acres of dry buildable land <br /> and 200' of width per building site. The viability of the property just as a single building site for <br /> new construction is also a question mark given the required boundary setbacks, wetland setback <br /> and buffer requirements, well setback from landfill areas, the need for two on-site sewage <br /> treatment system sites meeting required separations from the creek, wetland and well, etc. These <br /> questions will likely not be ans���ered fully until the property owner or purchaser provides a <br /> Telephone(952)249-4600 • Fax(952)249-4616 <br /> www.ci.orono.mn.us <br />
