Ph.ase I Environmental Site Assessment September 2, 2009 <br /> 1 A INTRODUC'TION <br /> At the request of Mr. Frank Ferguson of the Blaine State Bank, Carlson Professional Services, Inc. <br /> (Carlson) has prepared this Phase I Environmental Site Assessment (ESA) for the Property located at <br /> 445 Bro��n Road South in Orono, Minnesota (referred to as the "Properry" or "Site"). This report <br /> summarizes the findings of the ESA, including historical uses of the Property. <br /> 1.1 Purpose and Scope <br /> The purpose of the ESA��as to provide information about the general environmental character of the <br /> Property and to satisfy one requirement to qualify for the "innocent landowner, contiauous property <br /> owner or bona fide prospective purchaser" limitations on Comprehensive Environmental Response, <br /> Compensation, and Liabiliry Act(CERCLA) liabiliry, in accordance with 42 USC §9601(35)(B), if the <br /> need should arise. That requirement includes conducting "all appropriate inquiry into the previous <br /> ownership and uses of the properry consistent v��ith good cominercial and custoinary practice." This <br /> Phase I ESA has been conducted following guidelines established by the American Sociery for Testing <br /> and Materials (ASTM) "Standard Practice for Environmental Site Assessments: Phase I Environmental <br /> Site Assessment Process," Standard E 1527-OS. <br /> The objectives of the ESA were to provide a revie�� of a broad base of historical sources, government <br /> records and regional information; observe physical conditions at the Properry and adjacent properties; <br /> provide an evaluation of potential sources and receptors of contaminants (if present); conduct <br /> interviews w�ith knowledgeable persons; and to evaluate user-provided information to provide an <br /> opinion of the information. Specifically, this assessment attempted to identify conditions indicative of <br /> releases or threatened releases of hazardous substances, as defined in CERCLA Section 101(14) <br /> §312.1(c)) and to determine if recognized environmental conditions (RECs) are present at the Site. A <br /> REC is defined by ASTM as the presence or likely presence of any hazardous substance or petroleum <br /> products on a property under conditions that indicare an existing release, a past release or a material <br /> threat of a release of any hazardous substance or petroleum products into structures on the Properry or <br /> into the ground, around v��ater, or surface water of the Properry. <br /> 1.2 Significant Assumptions <br /> This report provides a summary of past and present environmental concerns; however, this ESA is <br /> limited by the availabiliry of information that ��as reasonably ascertainable and a��ailable for revie�• at <br /> the time of the assessment. It is possible that contamination from unreported or unauthorized <br /> disposal for which there was no obvious indications exists on the Properry. <br /> 1.3 Limitations and Exceptions <br /> This assessment has been completed in accordance with the �enerally accepted methodologies referred <br /> to in the ASTM Standard Practice E 1527-05 for a Phase I ESA. <br /> • For rhe purposes of this Phase I ESA, certain information was relied upon that was provided <br /> by the User, defined by ASTM as "the parry seeking to use Practice E 1527-OS to complete an <br /> Carlson Professional Sera,�ices, Inc.
