� °� <br /> O ,, �+ _ O CITY of ORONO <br /> a �" <br /> '�'� � RESOLUTION OF THE CITY COUNCIL <br /> � ; l��"�� 6 � 1 9 <br /> '�' � w G~ N O. <br /> ��kESH04� <br /> A RESOLUTION <br /> GRANTING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-420 <br /> FILE NO. 13-3619 <br /> WHEREAS, Paul Warner and Jessica Warner, a married couple (hereinafter <br /> "the Applicants") are the owners of the property located at 1380 Briar Street within the City of <br /> Orono (hereinafter the "City") and legally described as: The West Half of Lots 3 and 4, Block <br /> 2, MARKVILLE (hereinafter the "Property"); and <br /> WHEREAS, the Appiicants have made appfication to the City of Orono for a <br /> variance from Orono Municipal Zoning Code Section 78-420 to allow construction of additions to <br /> the existing home 25 feet from the front property line where a 50 foot setback is required; 19 <br /> feet from the rear property line where a 50 foot setback is required; and 14.4 feet from the south <br /> ��f�o ��� ��no ��ihoro u vv fnn+ cc4h�nL 'c rcm ii�o.-1• r-1 <br /> ivv� .��.�uuv�. io i c.Mun cu, ai iu <br /> WHEREQS, after due published notice and mailed notice in accordance <br /> with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br /> Orono Planning Commission on August 19, 2013 at which times ali persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning Fife number 13-3619. <br /> 2. The Property is located in the RR-1 B One Family Rural Residential Zoning <br /> District which requires a minimum lot area of 2.0 acres and a minimum lot width <br /> of 200'. <br /> 3. The Pfanning Commission reviewed this appiication at a pubiic hearing held on <br /> August 19, 2013 and voted 6 for and 0 against on a motion to approve the <br /> setback variances. The Planning Commission finds that the following factors <br /> support the granting of the requested variances: <br /> a. The Property contains 14,000 square feet in area and has a defined width of <br /> 160-feet. The Property is 160 feet wide on Briar and 87.5 feet deep. it does <br /> not conform to the 2 acre minimurn fot size of the RR-1 B district. <br /> Page 1 of 4 <br />
