FILE#15-3745 � <br /> 17 Sept 2015 <br /> Page 4 of 5 <br /> application and the evidence submitted,the city must find that the proposed use at the <br /> proposed location is or will be: <br /> 1) Consistent with the community management plan; The applicant's proposal to <br /> repair the damage to the slope and prevent future sediment deposition into the <br /> lake is consistent with the Comp Plan. <br /> 2) Compliant with the zoning code, including any conditions imposed on specific uses as <br /> required by article V, division 3 of the City Code; The proposed project is residential <br /> in scope and scale and is compliant with the zoning code. <br /> 3) Adequately served by police, fire, roads, and stormwater management; This criterion <br /> is met. <br /> 4) Provided with an adequate water supply and sewage disposal system; Not <br /> applicable. <br /> 5) Not expected to generate excessive demand for public services at public cost; This <br /> condition will be met. <br /> 6) Compatible with the surrounding area as the area is used both presently and as it is <br /> planned to be used in the future; the proposed restoration of the slope and <br /> prevention of future erosion is compatible with the existing and future use of the <br /> properties. <br /> 7) Consistent with the character of the surrounding area, unless a change of character <br /> is called for in the community management plan; Staff believes the grading and <br /> sub-grade retaining walls within the 75-foot setback area to repair the erosion and <br /> ravines will have no negative impact on surrounding lands. The regraded areas will <br /> be hidden behind vegetative screening when viewed from the lake. <br /> 8) Compatible with the character of buildings and site improvements in the surrounding <br /> area, unless a change of character is called for in the community management plan; <br /> This condition is satisfied. <br /> 9) Not expected to substantially impair the use and enjoyment of the property in the <br /> area or have a materially adverse impact on the property values in the area when <br /> compared to the impairment or impact of generally permitted uses; The proposed <br /> grading for erosion repair,stormwater management and installation of the <br /> subgrade retaining walls will not change the intended residential use of the <br /> property so there should be no change in the use and enjoyment of adjacent <br /> properties. <br /> 10) Provided with screening and buffering adequate to mitigate undesirable views and <br /> activities likely to disturb surrounding uses; The applicant has provided a landscape <br /> plan which will serve to reestablish vegetation on the restored slope. <br /> 11) Not create a nuisance which generates smoke, noise,glare, vibration, odors,fumes, <br /> dust, electrical interference,general unsightliness, or other means; analysis in bold <br /> 12) Not cause excessive non-residential traffic on residential streets, parking needs that <br /> cause a demonstrable inconvenience to adjoining properties, traffic congestion,or <br /> unsafe access; The proposal will not result in excessive traffic or inconvenience to <br /> adjacent properties. <br /> 13) Designed to take into account the natural, scenic, and historic features of the area <br /> and to minimize environmental impact; The applicant has proposed vegetative <br /> screening over graded areas which will result in screening of the disturbed area <br /> from the lake in a natural manner. The installation of the sub-grade retaining walls <br /> and landscape plan will help to support the slope should help to improve water <br /> quality and prevent further erosion from the site. <br />
