Substandard <br /> properties, like the subject lot, are able ta be redeveloped without variances if specific <br /> standards are met;such as: <br /> 1. It is at least one acre in size, and the average width of the lot is at ieast 100 feet; <br /> 2. It is served by public sanitary sewer; and <br /> 3. It otherwise meets the requirements of this chapter or other applicable Code provisions. <br /> The applicant has requested a side street setback variance and, in doing so asserts that the <br /> property cannot conform to #3 above. Therefore, lot area and width variances are required in <br /> order to redevelop the property. <br /> Setback Varlances <br /> The properry is a corner lot with 50-foot setback requirements from Orono Orchard Road and <br /> Woodhill Avenue. A 30-foot side setback is required from the north side lot line. The side street <br /> properly line is 30 feet from the edge of the paved, traveled roadway,therefore, the proposed <br /> hame will be at least fi0 feet from the road. Normally,the edge of pavement is 12-20 feet from <br /> the edge of the right of way. The substandard width of the lot combined with the required 50- <br /> anci 30-foot setbacks result in an approximate 40' x60' building envelope.
