MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,October 19,2015 <br /> 6:30 o'clock p.m. <br /> question is located within Outlot C of East Willow Woods, a subdivision plat filed in 1990 which created <br /> two residential lots abutting Dickey Lake Drive and Pine Ridge Lane. It also created two commercial lots <br /> and three outlots. <br /> Staff is recommending vacation of this easement. Letters have been sent to the various utilities and Staff <br /> has not heard anything back. Gaffron stated the utility companies might request the City retain the <br /> easement for utility easements, but for purposes of the road,that is being extinguished. The property <br /> owner's legal access to the property will not be affected by the vacation of the easement in Outlot C and <br /> adjacent or nearby properties will have their access limited by it. <br /> Zoning Code Section 78-9 governs the vacation of streets, alleys and public grounds. In past vacation <br /> requests,the City has determined that vacations may be appropriate when the vacation does not affect <br /> access to or use of any adjoining property. Staff has determined that it does not in this situation. In <br /> addition,the City has not and does not intend to develop, improve, or use the dedicated right-of-way as <br /> road except for utilities and access purposes. Staff finds that the unimproved dedicated right-of-way as it <br /> exists serves no public purpose. It is Staffls opinion that these three conditions have been met. <br /> Staff recommends approval of the vacation. <br /> Lemke asked how much time the City gives the utilities to respond. <br /> Gaffron stated typically the ones that have an interest in it respond fairly quickly. Gaffron stated the <br /> letters just went out last week but that the City typically hears back in two weeks. <br /> Schoenzeit asked if the City could retain the utility easement. <br /> Gaffron stated if there are existing utilities, it is his belief the property owner would want to retain that <br /> easement. <br /> Landgraver asked if access to the well is on Pine Ridge. <br /> Gaffron indicated it is. <br /> Landgraver asked if the outlot continues to the right. <br /> Gaffron indicated outlots were created as part of the Sugarwoods subdivision and that there is an outlot <br /> that continues behind the Service 800 Building, the strip mall,the office building, and then the senior <br /> center. Gaffron stated at this point there does not seem to be any future need for this to be a through road. <br /> Acting Chair Landgraver opened the public hearing at 8:26 p.m. <br /> There were no public comments regarding this application. <br /> Acting Chair Landgraver closed the public hearing at 8:26 p.m. <br /> Lemke stated he would like to retain the utilities easement. <br /> Page 17 of 29 <br />
