� � � MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday, September 21,2015 <br /> 6:30 dclock p.m. <br /> Leskinen stated her only question is whether the four-season porch is going to be the practical difficulty <br /> for the next person. Leskinen stated the problem is the large structure is obstructing the view without the <br /> average lakeshore setback being measured from that point. <br /> Schoenzeit noted the view of the fireplace is only from the side windows and not the back windows. <br /> Lemke stated he tends to agree with Commissioner Landgraver and that he has not seen any practical <br /> difficulty for it. <br /> Thiesse stated they are improving the situation but not improving it completely. <br /> Schoenzeit stated when someone constructs a new house,they need to fix as many noncompliant items as <br /> possible. <br /> Leskinen stated the obstruction of their view is not something the applicants can correct when it is not <br /> part of the average lakeshore setback. Leskinen stated at first she did not believe it was a practical <br /> difficulty but has since come to the conclusion that it is. <br /> Schoenzeit stated the Planning Commission would not take into account the fact that three evergreen trees <br /> were planted on the neighbor's property when considering the average lakeshore setback. <br /> Thiesse stated he can see Commissioner Schoenzeit's point but that this is a peculiar case that got <br /> compounded when they moved the house further back. Thiesse stated the stone fireplace is in the way. <br /> Berg indicated she agrees with Commissioner Thiesse. <br /> Leskinen stated this is an unusual situation and that she does not believe it will set any unusual precedent. <br /> Thiesse stated the average lakeshore setback is protecting the view of the neighbor only and not <br /> environmental to anyone. Thiesse stated the average lakeshore setback is not as tight as some might <br /> think and that he is more concerned with the 75-foot setback to preserve people's views. <br /> Schoenzeit reiterated it is new construction and the house should be as compliant as possible. <br /> Leskinen stated she would rather grant an average lakeshore setback variance rather than a street setback <br /> variance. <br /> Berg moved,Thiesse seconded,to recommend approval of Application No. 15-3781,Stonewood, <br /> LLC,on behalf of Belle and Harry Yaffe,3185 Casco Circle,granting of lot area,lot width,and <br /> average lakeshore setback variance for a 6-foot encroachment and a variance allowing a 1.5 foot <br /> encroachment into the 30-foot rear setback. VOTE: Ayes 3,Nays 3,Schoenzeit,Landgraver,and <br /> Lemke opposed. <br /> Commissioners Landgraver and Schoenzeit stated they are opposed to the average lakeshore setback <br /> variance. <br /> Page 33 of 46 <br />
