Such a subdivision <br /> process does not exist within Orono Code. We believe that the reason such provisions do not <br /> already exist is that there are only a very few duplex situations in Orono and there has never been <br /> a request for such a split previously, hence no impetus for adding those provisions to the code. <br /> After discussions with City Attorney Soren Mattick, staff has concluded that the only way to <br /> effectuate such a split is revise the Subdivision Code by adding provisions to allow for this type <br /> of division. The Council was apprised of this situation at its March work session and indicated <br /> that staff should proceed with review of an amendment. <br /> History of Orono Code Provisions for Duplex Use <br /> The zoning code initially addressed duplex use via Ordinance 97 (1 st Series) in June 1968, <br /> allowing one duplex on a single lot in virtually all residential zones, provided that 1) public <br /> sanitary sewer is available; 2) the lot is adjacent to a commercial or industrial district; 3) the <br /> duplex is constructed within 200 feet of the commercial or industrial district; and noted that a <br /> duplex is defined as a two-family unit residential building. <br /> The 1975 Zoning Code incorporated the same language but limited duplexes to the R- and LR- <br /> Districts, and disallowed them in the Rural Residential 2-acre and 5-acre zones. <br />
