The former detached garage was located 1'2" from the side lot line and <br /> the new structure will be located 10'. <br /> C. The proposed improvement will result in a reduction of hardcover. <br /> D. If garagz was placed para11e1 to street meeting the 10' side and street <br /> setback, a large maple tree would have to be removed. <br /> E. If proposed garage was to meet the 30' street setback, the 10' separation <br /> setback between principal structure and detached structure could not be <br /> met. <br /> 4. The City Council fmds that the conditions existing on this properry are peculiar <br /> to it and do not apply generally to other property in this zoni.ng district; that <br /> granting the variance would not adversely affect tra�c conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring properry; would not merely <br /> ' serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial properry <br /> right of the applicants; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the communiry. <br /> CONCLUSIONS, ORDER A►ND CONDITIONS <br /> Based upon one or more of the above fmdings, the Orono City Council hereby <br /> grants a variance to Municipal Zoning Code Section 10.03, Subdivision 9 (B) to permit the <br /> construction of a 24'x24' detached garage within the street yard of the lakeshore lot to be located <br /> 15' from the street lot line instead of the required 30', subject to the following conditions: <br /> Page 2 of 5 <br /> .
