o 4,. <br /> O O CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> 2 <br /> 9kE3HD4 <br /> A RESOLUTION VACATING AN <br /> UNUSED PORTION OF FOREST BOULEVARD <br /> WITHIN THE PLAT OF SAGA HILL REVISED, <br /> SECTION 7, TOWNSHIP 117, RANGE 23 <br /> IN THE CITY OF ORONO, MINNESOTA <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, on May 27, 1988, Andrew B. Frieler and Allen P. Frieler, 1331 <br /> North Arm Drive, filed a petition with the City of Orono requesting the vacation of a portion <br /> of Forest Boulevard originally dedicated in the Plat of Saga Hill Revised legally described as <br /> follows: <br /> That part of vacated Forest Boulevard as dedicated in the plat of "Saga Hill Revised, <br /> Hennepin Co. Minn." which lies between the northwesterly extensions across it of the <br /> northeasterly line of Lot 4, Block 6, "Saga Hill Revised, Hennepin Co. Minn." and a <br /> line running from the midpoint of the northwesterly line of Lot 5, said Block 6, to the <br /> midpoint of the southeasterly line of said Lot 5. <br /> WHEREAS, after due published and posted notice, public hearings were held <br /> before the City Planning Commission on June 20, 1988 and March 15, 1993, regarding said <br /> vacation and all interested persons were given an opportunity to be heard; and <br /> WHEREAS, after due standing and consideration, the Planning Commission <br /> recommended approval of the requested vacation and the Council of the City of Orono finds that <br /> said vacation as proposed, is in keeping with the public interest in consideration of the following <br /> findings: <br /> 1. The vacation does not affect the access or the use of adjoining properties. <br /> 2. The City has not and does not intend to develop, improve, or use the dedicated <br /> right-of-way or Forest Boulevard for road purposes. <br /> 3.
