1 c� ?� ,..,, O � � � CITY of ORONO � �� ..� � � �� ' RESOLUTION OF Z'HE CITY COUNCIL � � ' �� " 3238 � � *. a �ti NO. ��9 g�G k'EsB� A RESOLUTION VACATING AN UNUSED PORTION OF FOREST BOULEVARD WITHIN THE PLAT OF SAGA HILL REVISED SECTION 7, TOWNSHIP 117 RANGE 23 IN THE CITY OF ORONO, MINNESOTA FILE NO. 1798 � WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and � WHEREAS, on January 20, 1993, Fred S. Ryan and Barbara Ryan filed a petition with the City of Orono requesting the vacation of a portion of Forest Boulevard originally dedicated in the plat of Saga Hill Revised legally described as follows: That part of Forest Boulevard as dedicated in the Plat of "Saga Hill Revised, Hennepin • County, Minnesota" which lies between the northwesterly extensions across it of the � southwesterly line of Lot 7, Block 6, "Saga Hill Revised Hennepin County, Minnesota" and a straight line running from the mid-point of the northwesterly line of Lot 5, said Block 6 to the mid-point of a southeasterly line of said Lot 5; and WHEREAS, after due published and posted notice, a public hearing was held before the City Planning Commission on February 16, 1993, regarding said vacation and all interested persons were given an opportunity to be�heard; and WHEREAS, after due standing and consideration, the Planning Commission recommended approval of the proposed vacation and the Council of the City of Orono fmds that said vacation as proposed is in keeping with the public interest and in consideration of the following fmdings: 1. The vacation does not affect the access or the use of adjoining properties. 2. The City has not and does not intend.to develop; improve, or use the dedicated right-of-way of Forest Boulevard for road purposes. 3. The City has not and does not intend to maintain or install utilities within the dedicated right-of-way of Forest Boulevard. • � Page 1 of 2 f��o,��
