,t,, ,'. <br /> � O� <br /> O O <br /> � �b. - C ITY of ORONO <br /> � � <br /> ti <br /> �� G�' RESOLUTION OF THE CITY COUNCIL <br /> L�kESH�4� NO. 3 2 0 2 <br /> c) The existing drainage pattern of the property provides <br /> for positive drainage to the lake over extensive <br /> grassed yard areas. <br /> d) The proposed improvement of the property will also <br /> result in a decrease in hardcover within the 0-75' <br /> setback area, reduced from 11.7$ to 10�. <br /> e) The current residence does not have a garage nor a <br /> basement area to provide additional storage area. <br /> f) The proposed street setback for the detached garage <br /> will prevent the cutting into of the existing root <br /> system of a group of trees well over 100 years old <br /> located in the east yard area. <br /> • 4. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to <br /> other property in this zoning district; that granting the <br /> variance would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to � <br /> preserve a substantial property right of the applicants; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> � Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including <br /> the findings and recommendations, reports by City staff, <br /> comments by the applicants and the effect of the proposed <br /> variances on the health, safety and welfare of the <br /> community. <br /> CONCLIISIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted above, the <br /> Orono City Council hereby grants variances to Municipal Zoning Code <br /> Section 10.22, Subdivision 2 and Section 10.24, Subdivision 5 (B) that <br /> would permit the construction of a detached garage to the location <br /> within the street yard of the property subject to the following <br /> conditions: <br /> • Page 2 of 6 <br />
