� ��o� <br /> � C ITY OF QRONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> i r- <br /> �i �'~� NO. � J � � <br /> akES HO�� <br /> A RESOLUTION <br /> GRANTING A VARIANCE TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1434(3) and 78-1435 <br /> FILE NO. 15-3794 <br /> WHEREAS, Tim Doubek and Mary Doubek, husband and wife, (hereinafter"the <br /> Applicants") are the owners of the property located at 4565 Bayside Road within the City of <br /> Orono (hereinafter the "Cityn) and legally described as follows: Lot 2, Block 1, Bayside Berry <br /> Farm, Hennepin County, Minnesota (hereinafter the"Property"); and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Sections 78-1434(3)and 78-1435 to allow construction <br /> of a 2,400 square foot pole building defined as an oversized accessory structure(hereinafter the <br /> "OAS") in a location nearer to the front or street lot line than the principal building on the Property <br /> where no accessory structure is normally allowed; and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public <br /> hearing on November 16, 2015 at which times all persons desiring to be heard concerning this <br /> application were given the opportunity to speak thereon; and <br /> WHEREAS, on November 16, 2015, the Planning Commission, with a vote of 6 <br /> to 0, recommended approval of the variance; and <br /> WHEREAS, on December 14, 2105, the City Council reviewed the application <br /> and the recommendations of the Planning Commission and City staff. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br /> Minnesota hereby approves the requested variance as described above based on one or more <br /> of the following findings of fact concerning this Property: <br /> FINDINGS OF FACT <br /> 1. This application was reviewed as Zoning File #15-3794. The analysis contained <br /> within staff memos and the exhibits attached to the aforesaid memos, all minutes <br /> from the above mentioned meetings, and any and all other materials distributed <br /> at these meetings are hereby incorporated by reference. <br /> 2. The Property is located in the RR-1 B One Family Rural Residential Zoning <br /> District. <br /> Page 1 of 7 <br />
