CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />No. <br />6 56 3 <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />RESOLUTION NO. 6563 <br />A RESOLUTION DISPENSING WITH STATUTORY <br />REQUIREMENTS FOR REVIEW BY PLANNING <br />COMMISSION OF ACQUISITION OF PROPERTY AND <br />APPROVING PURCHASE AGREEMENT <br />WHEREAS, the City of Orono is proposing to acquire for a municipal well certain real <br />property located in the City of Orono, Hennepin County, Minnesota, ("Property"), legally described <br />in and pursuant to the terms of the proposed purchase agreement between Clifford L. Offen & <br />Louise W. Offen and the City ("Purchase Agreement"), attached hereto and incorporated herein as <br />Exhibit "A"; and <br />WHEREAS, Minn. Stat. §462.356, subd. 2 requires that the Planning Commission review <br />the City's proposed acquisition of real property for compliance with the comprehensive plan and to <br />report to the City Council in writing its findings; and <br />WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the requirement <br />for review by the Planning Commission upon 213 vote of the City Council dispensing with the <br />requirement and finding that the acquisition or disposal of the real property has no relationship to <br />the comprehensive municipal plan. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono: <br />1. City Council finds that the acquisition of the Property under the Purchase Agreement <br />has no relationship to the comprehensive plan. <br />2. Review by the Planning Commission of the acquisition of the Property is hereby <br />dispensed with, the proposed transaction is hereby approved and the Mayor and City Clerk are <br />authorized and directed to execute all documents, and take all appropriate measures to acquire the <br />Property under the terms of the Purchase Agreement. <br />
