MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, November 23, 2015 <br />7:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br />Page 31 of 41 <br /> <br />McMillan stated the developer can draw Shadywood out separately and then divide Kelly into one acre <br />lots. McMillan stated she is not sure how many units can fit on the Shadywood side and that it is <br />currently zoned for an office building, which would require a change in zoning. <br /> <br />Levang stated the recommendation from Metropolitan Council is four to five units per acre. <br /> <br />Barnhart stated the Comprehensive Plan shows it as a mixed use, which is 4 to 15 units. <br /> <br />Levang noted that would be 4 to 15 per acre. <br /> <br />McMillan stated it could be an apartment building. <br /> <br />Levang stated there is a gamble if it is not a PUD because it could be commercial, mixed use or <br />residential, and that the Council would have to rezone if it is not office use. Levang stated in her view <br />that is a big gamble. Levang stated she is agreeable with splitting it into two parcels and that she would <br />hope the driveway would be minimal at best on the Kelly side. Levang noted tree preservation would be <br />out of the City’s hand. <br /> <br />Wasmoen stated they would need to start all over with their plans. <br /> <br />Levang asked if the barn is something that will be retained. <br /> <br />Wasmoen stated the barn is on the Shadywood side and that he is not sure what will happen to it. <br /> <br />Council took no formal action on this item. <br /> <br />9. #15-3780 MICHAEL AND LISA LARSON, 3596 SHORELINE DRIVE, CONDITIONAL <br />USE PERMIT <br /> <br />Barnhart noted two weeks ago the Council agreed to grant a conditional use permit for The Woofington <br />and directed Staff to draft an approval resolution. A resolution has been drafted and is before the Council <br />tonight. <br /> <br />Walsh recommended the resolution be amended to require a state license from the State Board of Animal <br />Health. Walsh indicated he has forwarded information on that license to Jeremy and that it is a yearly <br />state license. <br /> <br />Walsh moved, Printup seconded, to adopt RESOLUTION NO. 6561, a Resolution Granting a <br />Conditional Use Permit Pursuant to Municipal Zoning Code Section 78-644, Subsection 11 <br />Through 13, with the addition of Item No. 11 requiring the applicants obtain a license from the <br />Minnesota State Board of Animal Health. <br /> <br />McMillan stated she still has some concerns with the close proximity of this facility to the neighbors but <br />that she will vote in favor of the resolution because it includes everything that the majority of the Council <br />felt was important to address the concerns raised by the neighbors. <br /> <br />Walsh stated he would echo those same comments. <br />
