O
  ' CITY of ORONO
O :,, O .
  RESOLUTION OF THE CITY COUNCIL
• ' ' ';b: ''' '
, .Y . ti N0. a . .
G
9Es8g' . '
3. The Orono Planning Commission reviewed this application on September 20,
1993 and recommended approval of the variances as proposed based upon the
following hardships or unique findings:
A. The accessory structure has existed on the property for over 30 years prior
 to current zoning standards.
B . If the structure was to b.e moved to the south to meet the required street
setback, steep elevations would require extensive filling.
C. Both proposed additions to the accessory structure will meet therequired
10' side yard setback.
D. The lot at 20,700 s.f. would e allowed 15% lot coverage. The
 applicant's unprovements are proposed at 2,557 s.f. or 12.3%.
• E. The applicant proposes 138.4 s.f. of new structural hardcover and the
. removal of 720 s.f. of non-structural hardcover; over one-third of the
hardcover removals are located within the 0-75' setback area.
4. The City Council has considered this applicationincluding the fmdings and
recoriiinendat'ions of the Planning Commission, reports by Ciry staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
.. • to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial property
. right of the applicant; and would be in keeping with the spirit and intent of the .
Zoning Code and Comprehensive Plan of the City.
  . . FarmSWS DiskOtono
