The only variance sought for the improvement is a side setback variance <br /> from the east lot line. <br /> C. The existing elevations and the mature vegetation will minimize impact of <br /> second story expansion on residence to east. <br /> D. Staff has received no negative comments from adjacent neighbors who <br /> have signed acknowledgment forms. <br /> E. The existing structure consists of only one bedroom and is incapable of <br /> supporting the needs of a growing family. ' . <br /> F. The residence structure is located 7'2" from the east side lot line and the <br /> � existing fireplace is 4'8". The proposed improvements will extend no <br /> � closer to east lot line. <br /> • 4. The City Council fmds that the conditions existing on this property are peculiar � <br /> � to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring properry; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> �I��° ��� demonstrable hardship or difficulty; is necessary to preserve a�substantial properry <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. � <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit the <br /> construction of a second story above an existing single story residence to be located 4'8" from <br /> east side lot line requiring a 5'4" or 54% variance, subject to the following conditions: <br /> � Page 2 of 5 <br /> Fam 5005 Disk Qaa <br />
