Hardcover within the 0-75' setback has been reduced by 6.2% and total <br /> � . hardcover on the property is maintained at 19.8%. <br /> ' H. Hardcover within the 0-75' setback area shall be maintained at 1,089 s.f. <br /> or 9.6% and in the 75-250' setback area hardcover shall be maintained at <br /> 4,086.5 s.f. or 27.5%. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> � pose a fire hazard or other danger to neighboring properry; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is neeessary to preserve a substantial property <br /> . right of the applicants; and would be in keeping with the spirit and intent of the <br /> • Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the fmdings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the communiry. � <br /> . CONCLUSIONS, ORDER AND CONDITIONS . <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Sections 10.22, Subdivisions 1 (B) and 2 and Section <br /> 10.24, Subdivision 5 (B) to permit the construction of a residence measuring 43'x50' requiring <br /> a 19' or 25.3% lakeshore setback variance, a 6' encroachment of the average lakeshore setback, <br /> 9.6% hardcover variance within the 0-75' setback area and a 2.5% hardcover variance within <br /> the 75-250' setback area. This approval is subject to the following conditions: <br /> 1. Authorities granted by this variance run with the property not with the applicants, <br /> but are permissive only and must be exercised by application for a building <br /> permit within one year of the date of Council approval, or this variance will <br /> expire on that date (September 13, 1994). <br /> • Page 3 of 5 <br /> Fam 5005 IXsk Qaw <br />
