One corner of the proposed screen porch will encroach 1' into the � <br /> required 35' setback, such encroachment covering approximately 5 s.f. ` <br /> ; <br /> B. The screen porch will be constructed directly above the existing upper <br /> level deck which similarly encroaches the front setback as noted above. <br /> C. The proposed location of the screen porch requires no other setback �: <br /> variances, even though a large portion of the existing house is located � <br /> nearer the rear lot line than the current code requirements. '�, <br /> D. The proposed screen porch location wili be the least obtrusive to the site <br /> and to the neighbors. <br /> • E. The current floor plan and unusual shape and orientation of the property <br /> limit locations for lake views from the house or yard. <br /> F. No other variances are necessary. <br /> 4. The City Council has considered this application including the �ndings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traf�c conditions, light, air nor <br /> � pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> - - Zoning Code and Comprehensive Plan of the City.- <br /> � <br /> _ Page 2 of 5 <br /> � � � � Form 5005 Disk Oronc <br />
