O�' CITY of ORONO <br /> O_ � O <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. $ 458 <br /> ESH <br /> A. The site consists of 23 acres but the topography has placed severe limits <br /> on the building site. <br /> B. The location of the kitchen within the residence limits the proposed family <br /> room expansion to the east and south. <br /> C. Extensive vegetation exists along the south lot line and the natural building <br /> site for the adjacent property would be approximately 150' or more south <br /> from the applicant's property. <br /> D. The setback proposed at 31.4' is no less than the minimum 30' side <br /> setback approved for lots within the adjacent PRD of Cristofori Woods. <br /> E. The existing house was placed 75' from the west lot line rather than the <br /> standard 100' via a variance granted in 1992, and at the 50' south side <br /> setback line due to steeply sloping topography and to minimize erosion <br /> and the need for major cutting into steep elevations. <br /> F. Severe slopes to the east and north required placement of the house at this <br /> location in order to minimize the impact on existing dense vegetation. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> Page 2 of 5 <br /> FM ears Disk Qaro <br />
