The City Council finds that the conditions existing on this properry are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as 'a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> � right of the applicant; and would be in keeping with the spirit and intent of the � <br /> Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> � Based upon the above fmdings, the Orono City Council hereby grants a variance <br /> to Municipal Zoning Code Section 10.03, Subdivision 9 (C-3) and Subdivision 9 (D) to allow <br /> the proposed accessory structure to be� located nearer the front lot line than the principal <br /> • building; and grants a variance to Section 10.03, Subdivision 9 (C) to allow the oversized <br /> accessory structure a footprint of 1,800 s.f. where only 1,600 s.f. footprint would normally be <br /> allowed, subject to the following conditions: <br /> 1. The oversized accessory structure shall be subject to the standard covenant <br /> requirements of Zoning Code Section 10.03, Subdivision 9 (C-3c). <br /> 2. Per applicant's proposal, the exterior of the accessory building shall be finished <br /> similarly to the existing residence structure. <br /> 3. The proposed accessory structure shall be located as proposed by the applicant on <br /> the site plan attached as Exhibit A. Any changes to this location which places the <br /> structure nearer the west or north lot lines shall be subject to further review by <br /> the City. <br /> 4. Authorities granted by this variance run with the property not with the applicant, <br /> but are permissive only and must be exercised by application for a building <br /> permit within one year of the date of Council approval, or this variance will <br /> expire on that date (May 9, 1995). <br /> • Page 3 of 5 <br /> r�soos a�o� <br />
