If addition was placed to the rear of the structure, it would have a major <br /> impact on access to natural lighting to existing living areas of home. <br /> C. The existing residence is located 30' from the street lot line and <br /> approximately 36' from the actual traveled road of Crystal Place. <br /> D. The proposed addition will align with the existing deck and stair within <br /> the street yard of the property to the immediate west. <br /> E. The three season porch to be installed to the north side of the residence <br /> will have no visual impact upon the residence to the immediate east <br /> because of the location of mature year round plantings on the property. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit <br /> construction of a 12'x16.4' three season porch addition to the north side of the existing residence <br /> approving a 12' or 40% variance, subject to the following conditions: <br /> Page 2 of 5 <br /> Form 5005 Disk Orono <br />
