Meet with staff on the site to inventory and mark all trees of 6" diameter <br /> or greater in the 0-75' zone, and modify the proposed replanting plan to <br /> include replacement of all such trees in the 0-75' zone (on a tree-for-tree <br /> basis) that are ultimately removed to accommodate the construction. <br /> 3. Applicants and their contractors shall adhere to the "Best Management Practices <br /> for Protecting Water Quality in Urban Areas", and shall take whatever erosion <br /> control measures the City deems necessary for erosion control on the site. <br /> 4. The City Engineer shall make periodic inspections of the site during construction <br /> and a final inspection of the driveway prior to its final approval. <br /> 5. Revegetation of disturbed soils at the site shall include sodding of all disturbed <br /> slopes as soon after commencement of grading as is feasible. The re-planting <br /> plan for trees and shrubs is attached to this resolution as Exhibit A (to be <br /> modified as noted above), and all proposed plantings shall be completed per said <br /> plan prior to issuance of a Certificate of Occupancy for a new residence on the <br /> property, or within one year of the commencement of driveway construction, <br /> whichever is sooner. <br /> 6. Authorities granted by this resolution run with the property not with the owners, <br /> but are permissive only and must be exercised by application for a building <br /> permit for a residence on the property within one year of the date of Council <br /> approval, or the special conditions of this resolution will expire on that date <br /> (November 28, 1995). <br /> 7. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the Zoning Code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 8. The undersigned applicants have read, understood and hereby agree to the terms <br /> of this resolution and on behalf of themselves, their heirs, successors and assigns, <br /> hereby agree to the recording of this resolution in the chain of title of the <br /> property. <br /> Page 6 of 8 <br /> Form 5005 Dish Orono <br />
