The impact of the proposed plan as viewed from the lake is no greater <br /> than the impact provided by other alternatives for driveway location on the <br /> property. <br /> h. With minor revisions to applicants' plan, the concerns of the City <br /> Engineer in regard to Ili\ 1ioject can be. resolved. <br /> 7. The Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district; that granting <br /> the variance would not adversely affect traffic conditions, light, air nor pose a <br /> fire hazard or other danger to neighboring properties, would not merely serve as <br /> a convenience to the applicant, but is necessary to alleviate a demonstrable <br /> hardship or difficulty; is necessary to preserve a substantial property right of the <br /> applicant; and would be in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> 8. The City Council finds that granting a conditional use permit to allow the <br /> driveway construction in the 0-75' lakeshore setback zone will not be detrimental <br /> to the health, safety or general welfare of the public, would not adversely affect <br /> light, air nor pose a fire hazard or other danger to neighboring property, nor will <br /> it depreciate surrounding property values and that the proposed level of use of the <br /> property will be in keeping with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Municipal Zoning Code Section 10.23, Subdivision 6 (B) to allow residential <br /> development of a lot 165' in width and 1.97 acres in area where 200' of width and 2.0 acres in <br /> area are normally required; and grants a variance to Section 10.22, Subdivision 2 and Section <br /> 10.56, Subdivision 16 (L) to allow hardcover in the 0-75' lakeshore setback zone of 1,266 s.f. <br /> or 42.6% where no hardcover is normally allowed; and grants a variance to Section 10.56, <br /> Subdivision 16 (I) and (J) to allow intensive vegetation clearing and grading and filling within <br /> the 0-75' lakeshore setback zone and within a bluff impact zone where intensive vegetation <br /> clearing and grading and filling is normally not allowed; and grants a conditional use permit per <br /> Section 10.03, Subdivision 19 for grading within the lakeshore zone, subject to the following <br /> conditions: <br /> Page 4 of 8 <br /> Form 5005 Dish Orono <br />
