Proposed addition will be located 1'4" further from west side lot line. <br /> The existing structure exists at 7' and the new structure will be located <br /> 8'4" from the side lot line. <br /> F. The City Engineer has approved the location of the new curb cut located <br /> at Fagerness Point Road. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a Bre hazard or other.danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Sections listed above to permit construction of a <br /> 23.5'x44.3' addition to the west side of the existing residence subject to the following <br /> conditions: <br /> 1. All hardcover improvements scheduled for removal as shown on Page 7 of this <br /> resolution must be completed prior to the footing inspection for new construction. <br /> Applicant shall be allowed to retain blacktop area at the northwest corner of <br /> property for the use of construction vehicles and the storage of materials during <br /> the construction. Blacktop area must be removed prior to the issuance of a <br /> certificate of occupancy for the new construction. <br /> 2. Appiicant shall obtain a demolition permit prior to the removal of the 25'x44.3' <br /> addition. <br /> Page 3 of 7 <br />
