CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />4 ] f;' Ve/ NO. c) . <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBD. 9 (A) <br />FILE NO. #2406 <br />WHEREAS, Louis Smerling and Beverly Smerling are owners of the property <br />located at 2683 Casco Point Road within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />Lot 1, "Auditor's Subdivision Number Two Hundred Sixty-Five (265), Hennepin <br />County, MN" (hereinafter "the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission <br />held a public hearing on August 17, 1998, at which times all persons desiring to be heard <br />concerning this application wer~ given the opportunity to speak thereon; and <br />WHEREAS, Gerald Erickson and Sandra Erickson (hereinafter "the applicants") <br />have applied to the City for a variance to Municipal Zoning Code Section 10.03, Subd. 9 (A); <br />to permit an accessory structure to remain on the lot without a principal structure for the period <br />between the removal of the existing house and construction of a new residence. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #2406. <br />2. The property is located in the LR-IC Single Family Lakeshore Residential <br />Zoning District where 1/2 acre or 21,780 sq. ft. is the minimum lot area. The <br />property consists of .46 acres or 20,230 sq. ft. <br />3. The Orono Planning Commission reviewed this application on August 17, 1998 <br />and recommended approval by a vote of 6 to 0. <br />4.
