CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.-,;,"i-,f;f;-~if-/1----- <br />e. Topography of the site is severe, and with construction of a new residence <br />the opportunity exists to improve drainage by reducing the impact of <br />drainage on neighboring properties and the potential negative impact on <br />the bluff existing at the lakeshore. Certain grading and excavation is <br />necessary within the 0-75' setback and within the bluff impact zone in <br />order to improve the drainage. <br />f. No average setback, bluff setback, or structure height variances are <br />required. <br />g. Applicants have addressed to the satisfaction of the Planning Commission <br />the concerns raised by the neighboring adjacent property owner to the <br />south. <br />4. Planning Commission further recommended that City approval reference the site <br />plan and house plans, and the grading and drainage plan as modified by the City <br />Engineer. The Planning Commission further recommended that any written <br />agreement reached between the applicants and the neighbor to the south be <br />referenced in the City approval resolution. Planning Commission further <br />recommended that no future hardcover variances should be granted for this <br />property. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />6. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances and conditional use permit would not adversely affect <br />traffic conditions, light, air nor pose a fire hazard or other danger to neighboring <br />properties; would not merely serve as a convenience to the applicants, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicants; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />Page 3 of 6 <br />Form5005 Disk Orono
