(approximate) <br />Application: Applicant is requesting a conditional use permit to allow for excavation <br />of a pond in a floodplain to remain. The applicant obtained a permit <br />from the Minnehaha Creek Watershed District (MCWD) to excavate in a <br />wetland for a wildlife pond. A conditional use permit is required to <br />Planning <br />Commission <br />alter land in a wetland. <br />Recommendation: To unanimously approve: <br />COUNCIL ACTION <br />1. A conditional use permit, subject to the following conditions: <br />a. The applicant shall grade the slopes around the pond <br />to a 3 to 1 ratio or less. <br />b. The applicant shall maintain the pond in a manner that <br />does not adversely impact the right-of-way and roadway. <br />c. The applicant shall landscape the area around the pond <br />with natural vegetation such as cattails and prairie grasses. <br />REQUESTED: To approve the enclosed resolution.
