� O ' V <br /> O O <br /> CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> SH04' NO. 3635 <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Municipal Zoning Code Section 10.56, Subdivision 16 (J-2) and a <br /> conditional use permit per Section 10.03, Subdivision 19 and 10.56, Subdivision 13 (A&B) to <br /> allow the excavation of 34 cubic yards and the filling of 8 cubic yards of clean fill to allow <br /> the alteration of a lakeshore bank at a 3:1 slope, subject to the following conditions: <br /> 1. Erosion control shall remain in place until natural groundcover is restored within <br /> the disturbed area. <br /> 2. Banks are to be installed at a minimum 3:1 slope. <br /> 3. Applicant or applicant's contractor shall be responsible for obtaining a land <br /> alteration permit from the City for the approved land alterations completed <br /> before Council's review. Applicant or applicant's contractor shall pay a penalty <br /> permit fee at $150.00 ($75.00 initial, $75.00 penalty fee). <br /> 4. Authorities granted by this resolution run with the property not with the owner, <br /> but are permissive only and must be exercised by application for a land <br /> alteration permit within one week of the date of Council's approval, or the <br /> special conditions of this resolution will expire on that date (November 20, <br /> 1995). <br /> 5. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the Zoning Code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> 6. The undersigned applicant has read, understood and hereby agrees to the terms <br /> of this resolution and on behalf of himself, his heirs, successors and assigns, <br /> hereby agrees to the recording of this resolution in the chain of title of the <br /> property. <br /> Page 3 of 5 <br />
