Planning Commission finds no justification for the initially proposed boulder <br /> walls at the base of the lakeshore bank, and finds no justification for the <br /> proposed excavation of the lakeshore bank to remove poison ivy. <br /> b. Planning Commission finds that construction of a boulder retaining wall at <br /> the top of the lakeshore bank will help to prevent surficial erosion from the <br /> ' yard azea near the house in the 0-75' zone without significant impact to the <br /> lakeshore bank nor to the existing trees and shrubs. <br /> c. Planning Commission fmds that the proposed plantings on the slope of the <br /> lakeshore bank are acceptable only in the context of no grading or excavation <br /> ' of the slope. <br /> � d. Planning Commission finds that the existing mulched area lined with <br /> � landscape fabric does not benefit from said fabric which constitutes <br /> hardcover, and therefore the fabric should be removed. <br /> e. Planning Commission fmds that the only hardcover appropriate for the 0-75' <br /> lakeshore setback zone on this property is the 4' x 40' existing stairway and <br /> the approximately 961ineal feet of nominally 2' wide boulder wall proposed <br /> at the top of the lakeshore bank. These noted items of hazdcover constitute <br /> approximately 352 s.f. or 3.7% in the 0-75' zone. <br /> 4. The City Council has considered this application including the fmdings and <br /> recommendations of the Planning Commission, reports by City staff, comments by <br /> the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> 5. The City Council fmds that granting the variances and conditional use pernut per the <br /> revised proposal will not be detrimental to the health, safety or general welfaze of the <br /> public,would not adversely affect light, air nor pose a fire hazard or other danger to <br /> neighboring property,nor will its use depreciate surrounding property values and that <br /> the proposed level of use of the property will be in keeping with the intent and <br /> objectives of the Zoning Code and Comprehensive Plan of the City. <br /> • Page 2 of 5 <br />
