Applicant has provided a grading, drai.nage and landscape plan providing for <br /> stormwater management and improving shore fishing access in accordance with the <br /> Americans with Disabilities Act. <br /> 5: The City Council finds that granting a conditional use permit to a11ow the repair of , <br /> the seawall will not be detrimental to the health, safety or general welfare of the <br /> � public,would not adversely affect light, air nor pose a fire hazard or other danger to <br /> neighboring properties,nor will its use depreciate surrounding property values and <br /> that the proposed level of use of the property will be in keeping with the intent and <br /> objectives of the Zoning Code and Comprehensive Plan of the City. <br /> 6. The City Council has considered this application inclucling the fmdings and <br /> recommendations of the Planning Commission,reports by staff and comments of the <br /> applicant and the affect of the proposed use on the health, safety, and welfare of the <br /> � community. <br /> CONCLUSIONS, ORDER AND CONDITIONS . <br /> Based upon one or more of the findings, the Orono City Council hereby grants a <br /> conditional use permit per Municipal Zoning Code Section 10.03, Subdivision 19 to permit the <br /> repair of the seawall at the North Arm access subject to the following conditions: <br /> 1. Applicant shall install a treatment facility for surface water control as it relates to <br /> sediment,debris and other pollutants that wash into Lake Minnetonka from the paved <br /> paxking area at the North Arm access. All improvements shall be installed per <br /> concept plan dated July 20, 1995 by the Hennepin County Department of <br /> Environmental Management and the Minnesota Department of Natural Resources <br /> Trails and Wate�-ways Unit, attached to this resolution. <br /> 2. A maintenance schedule shall be established by the applicant for- the three <br /> sedimenta.tion infiltration areas. Maintenance procedure shall also include the <br /> cleaning of geo-textile fabric within the french drain to ensure against flooding and <br /> damage to surrounding plantings. � <br /> � Page 2 of 4 . <br />
