Planni.ng , <br /> Commission finds that the hardcover areas recommended for removal are <br /> not necessary to support the integrity of the property, and there is no <br /> hardship to justify the continued existence of said hardcover in Iight of the <br /> current hardcover variance request. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the communiry. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances and conditional use permit would not adversely affect <br /> • traffic conditions, light, air nor pose a fire hazard or other danger to neighboring <br /> properry; would not merely serve as a convenience to the applicants, but is <br /> � necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicants; and would be in keeping <br /> with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. � <br /> � CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above fmdings, the Orono City Council hereby <br /> grants a conditional use permit per Municipal Zoni.ng Code Section 10.03, Subdivision 19 and <br /> variances to Sections 10.22, Subdivision 1 and 2, Section 10.55, Subdivision 8, Section 10.56, <br /> Subdivision 16 (C) and (I.) to allow certain structure and hardcover and retaining walls in the <br /> 0-75' lakeshore setback zone where no structure or hardcover is normally allowed, as follows <br /> and per the following conditions: <br /> • Page 3 of 8 <br />
