The 19,920 s.f. lot is consistent with developed lots within the <br /> neighborhood ranging from 12,000 s.f. to 37,000 s.f. <br /> D. In a report dated September 8, 1994, the City Engineer confirmed that the <br /> proposed drainage plans for the developed site will not impact adjacent <br /> developed properties to hotly the Past and west side of the property. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to permit the <br /> construction of a new residence on the property located at 4455 Elm Street and grants an area <br /> variance of 23,640 s.f. or 54%, subject to the following conditions: <br /> 1. All residential improvements on this site shall meet all required setback and <br /> hardcover standards of the LR-1B, Lakeshore Residential Zoning District. <br /> 2. Upon application for a building permit, the applicants shall provide a detailed <br /> grading plan showing proposed driveway grading, tree removal and/or retaining <br /> wall. Further, such site grading plan shall indicate the use of a swale, drain tile, <br /> or other acceptable method to transport roof runoff to the north boundary of the <br /> property to minimise direct runoff impact on the neighboring property to the <br /> west. <br /> Page 2 of 4 <br />
