� O� <br /> O O <br /> �A� - CITY of ORONO <br /> � � � <br /> ti <br /> ��� �G'�' RESOLUTION OF THE CITY COUNCIL <br /> 9kESH04� .NO. e� � s � <br /> WHEREAS, the subdividers have revised the original proposal to yield a 50' rear <br /> setback from the new southerly property boundary of Parcel A to the existing shed; and <br /> WHEREAS,the owner of Lot 1,Block 2 has agreed to remove the existing 48'x21' <br /> quonset hut on said lot, thereby decreasing the footprint of all accessory structures on Parcel A to <br /> 3,168 s.f. which would normally require a lot area of 3.51 acres; and <br /> WHEREAS,because the oversized accessory structure is an existing struciure it is <br /> appropriate to grant variances to Municipal Zoning Code Section 10.03, Subdivisian 9 (C)to allow <br /> the shed to remain. <br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of <br /> Orono hereby approves the metes and bounds subdivision of a lot line rearrangement f'or Irvin T. <br /> Geffre and Robert S. Olson as shown on the Certificate of Survey by Raymond A. I'rasch, a <br /> registered land surveyor of Lot Survey Company, Inc., dated May 22, 1995, revised November 8, <br /> 1995 and attached to this resolution, and grants a variance to Section 10.03, Subdivision 9 to allot� <br /> th� continuation of the existing oversized accessory structure on the property, subject to tl�e <br /> following conditions: <br /> 1. Applicants shall complete conveyance of the "residual" parcel from one owner to the <br /> other in a manner acceptable to the City Attorney. <br /> 2. Applicants shall provide a title opinion of both parcels confirming ownership a�d <br /> encumbrances. <br /> 3. Upon City Council approval of this subdivision, the respective owners must lega7ly <br /> combine for tax purposes all of the existing and newly created parcels by in.tended <br /> ownership per the proposed]egal descriptions labeled Parcel A and Parcel B i�z the <br /> above noted survey. <br /> 4. Applicants shall remove the 48'x21' quonset building from Parcel A no l�ier t(�an <br /> June 1, 1996. <br /> 5. The aforesaid division shown on the attached Certificate of Survey shall be f li:d b}� <br /> the City of Orono with Hennepiri County Recorder's Office on or before August 12, <br /> 1996 together with a certified original copy of this resolution. <br /> Page 2 of 3 <br />
