Gardiner (hereinafter the <br /> "app?icar:t") �ilea a petition ��ith the City of �rono requestin� the vacation of an unimproved <br /> public right-of-way adjacent to his preperty originally dedicated in the plat of Ottoville on Lake <br /> Minnetonl:a, Hennepin County, I��innesota in 1887 and legally described as follo�vs: <br /> that part of alley adjacent to Lots 2 and 3 dedicated in the plat of <br /> Ottoville on Lake Minnetonlca lying southerly of the westerly extension <br /> of north line of said Lot 2 and northerly af the northwesterly right-of- <br /> way line �f County Road 84 (AKA Bayside Road) according to the <br /> recorded plat thereof, Hennepin County, Minnesota; and <br /> VVHEREAS, after due published and posted notice, public hearings �vere held <br /> before the City's Planning Commission on November 20, 1995 and January 16, 1996 regarding <br /> said vacation and all interested persons were given an opportunity to be heard; and <br /> `VHEREAS, after due standing and consideration, the Planning Commission <br /> recommended unanimous approval of the proposed vacation; and <br /> V4'HEREAS, the City Council of the City of Orono finds that said vacation as <br /> proposed is in keeping with the public interest and in consideration of the follo�ving findings: <br /> 1. The ri�ht-of-��vay as it exists today will not serve for public road use based on <br /> the pattern of residential development and access to adjacent properties. <br /> ?.
