O O <br /> �b. - CITY of ORONO <br /> ,� � <br /> '�' RESOLUTION OF�H�E C�IT�Y COUNCIL <br /> �i`9 4�'� NO. <br /> . kESHO <br /> � A RESOLUTION GRANTING A VARIANCE <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 10.24, SUBDIVISION 5 (B) <br /> FILE NO. 2106 <br /> WHEREAS, William J. Stoddard and Laura C. Stoddard (hereinafter "the <br /> , applicants") are the owners of the property located at 2605 Kelly Avenue within the City of <br /> Orono (hereinafter "the City") and legally described as follows: <br /> Lot 5, Block 5, Townsite of Langdon Park, including adjoining vacated 34 feet <br /> of Kelly Avenue, City of Orono, Hennepin County, Minnesota (hereinafier "the <br /> property"); and <br /> VVHEREAS, the applicants have applied to the City for a variance to Municipal <br /> . Zoning Code Section 10.24, Subdivision 5 (B) to permit the rebuilding of an exterior wall of <br /> a guest house located 3.1' from the west side lot line where a 10' setback is required. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2106. <br /> 2. The property is located in the LR-1B, Lakeshore Residential Zoning District <br /> requiring one acre in area. The property consists of 1.68 acres. <br /> 3. The Orono Planning Commission reviewed this application on February 20, 1996 <br /> and recommended approval of the proposed variance based upon the following <br /> unique findings and hardships: <br /> , A. Major landscaping improvements were completed at the time of the � <br /> renovation of the guest house and to relocate structure to the east in <br /> order to meet the 10' side setback would result in the loss of several new <br /> P plantings and retaining walls. <br /> ;• B.
