A ItESOY�UTION APPROVING TIiE <br /> . . .� � PLA1' OF:LAK�SIDE HEIGHTS <br /> FILE NO. 1921 <br /> VVHEREAS, the City of Orono is a municipal corporation organized and existing <br /> un�er the laws of the State of Minnesota; and <br /> �T��S, the City Council of the City of Orono has adopted. subdivision <br /> regulations for.�he orderly; economic and safe development of land witb.in the City; and <br /> �:'�V��I�AS, the City.Council has considered th� ap;�li�ation for a subdivisi�r�by ; <br /> T�1ary A. Ulrich (hereinafier "the subdivider"); and <br /> • W�REAS, on May 8, 1995,:the City Council approved Resolution No. 3`5b <br /> �rantiri� preliminary approval for a plat at.1000 Loma Linda Avenue; and <br /> WHEFf�AS, the property is located within the LR-1B Single Family Lakesl�7re <br /> Reside�tial Zon�ng District requiring a minimum of one acre of contiguous dry buildabtz land <br /> �.vithin each newly created lot. Each of the proposed lots meets the required one acre dr}� <br /> contigucus land area, Lot 1 being 1.27 acres in dry buildable area uid Lot 'L being 1.10 acres in � <br /> dry buildable area; and <br /> WfiEREAS, the Orono Comprehensive Plan requires only 33' of right-of-way for <br /> County Road 151 and therefore the City will require a 33' right-of-way dedication for County <br /> Road 151. Further, 25' of right-o.f-way will be dedicated on the plat for the north haif oi Lama <br /> Linda Avenue; and <br /> WHEREAS, due to the proposed dedication of right-of.-way for Loma Linda <br /> � Avenue, the existin� house within Lot 2 will remain at its existing location 33.0' from the riaht- <br /> of-way line where a 35.0' setback would normally be required. The Council finds it is <br /> a�propriate to grant a front setback variance to accommodate the existing house; and <br /> � WHEREAS, wetlands have been delineated in the northwesterly quadrant <br /> of proposed Lot 1, and a conservatiun and flowage easement has been granted over said wetlands; <br /> and <br /> � <br /> Page 1 of 4 <br />
