� O 'V <br /> O O <br /> CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��kES�I0 NO. 3 7 23 <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 10.03, SUBDIVISION 9 (D) AND <br /> SECTION 10.28, SUBDIVISION 5 (B) <br /> FILE NO. 2124 <br /> WHEREAS, John P. Earling (hereinafter "the applicant") is the owner of the <br /> property located at 2165 Colin Drive within the City of Orono (hereinafter "the City") and <br /> legally described as follows: <br /> Lot 2, Block 2, Kelley Green, Hennepin County, Minnesota (hereinafter "the <br /> property"); and <br /> WHEREAS, the applicant has applied to the City for variances to Municipal <br /> Zoning Code Section 10.03, Subdivision 9 (D) to permit construction of a detached garage to <br /> be constructed in front of the front line of the residence where the Code would require <br /> placement at the front line or behind residence structure. The structure will be located 12' from <br /> an unimproved road outlot where Code would require 50'. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2124. <br /> 2. The property is located in the RR-1B, Single Family Rural Residential Zoning <br /> District requiring two acres in area. The property consists of two-plus acres. <br /> 3. The Orono Planning Commission reviewed this application on April 15, 1996- <br /> and recommended approval of the variances as proposed based upon the <br /> follow*gig unique findings and hardships: <br /> Page 1 of 5 <br />
