Major <br />portions of the existing blacktop area located out of the easement also serve the property to the <br />immediate west of the subject property. The total area exclusive of the easement area is covered <br />with either blacktop or landscape areas underlain with plastic. Although the proposed <br />improvements area located within the 75-250' setback area, the Planning Commission did <br />condition approval on applicant removing approximately 198 s.f. of paved area to the east side <br />of the upper level garage. Refer to Exhibit J, the amended hardcover plan. <br />Applicant noted difficulty with removing hardcover within the 250-500' setback area <br />because of the steepness of the elevations and the detached garage has both an upper and lower <br />level with access drives provided at the north and west sides. Hardcover in the 75-250' setback <br />area has been reduced by 421 s.f. or 2.4%. Both structures meet the required setbacks of the <br />lakeshore zoning district. The portico will be located over an existing non-structural hardcover <br />improvement. Planning Commission members also noted that the 100' deep lakeshore yard is <br />grassed with no structure. <br />Planning Commission Recommendation <br />The Planning Commission recommended unanimous approval of the hardcover variances <br />as amended, based on the hardships set forth by applicant on Exhibit A reviewed as follows: <br />1. The existing dwelling was built in the 1920's prior to standards for lakeshore <br />development. <br />2. The house was originally installed on property where a street was designated between <br />the cottage and lake. The proposed improvements are designed to reverse interior <br />home to take advantage of the lake views. <br />3. Hardcover is reduced in the 75-250' setback area from 29.5% to 27.1 %. <br />4. There will be no impact upon the views of the neighbors nor on required setbacks. <br />5. There is approximately 176' x 100' of non-hardcover area within the lakeshore yard. <br />The grassed lawn gently slopes and receives the major portion of drainage that comes <br />from the higher elevations to the north. <br />The enclosed approval resolution has been drafted per the Planning Commission's <br />recommendation. <br />COUNCIL ACTION REQUESTED: <br />To either deny, approve or amend the enclosed approval resolution. <br />lsv
